agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and Batter and Crumbs LLC ("Batter & Crumbs," "we," "us," or "our"), operator of batterandcrumbs.com. By accessing the site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

eligibility

You must be at least 18 years old, or use the site under the supervision of a parent or guardian, and you must provide accurate information when you place an order or submit a form.

orders, pricing, and payment

Prices are listed in U.S. dollars and may change at any time. We work to keep item descriptions, availability, and prices accurate, but errors can occur; if we discover an error affecting your order, we may correct it or cancel the order and refund you.

Payments are processed by Square. By submitting an order, you authorize us, through Square, to charge your selected payment method for the total shown, including applicable taxes. We do not store your full card details.

Many of our items — signature and wedding cakes in particular — are made to order. Placing an order is an offer to buy; we may accept, decline, or cancel an order (for example, if an item is unavailable, a requested date can't be met, or we suspect fraud). If we cancel an order you've paid for, we will refund it.

pickup, delivery, and fulfillment

Cake and catering orders are prepared for pickup at our shop at 1401 Reed Street, Philadelphia, PA 19146, at the date and time you select, during our operating hours. Please pick up your order within the scheduled window; we cannot guarantee items left uncollected.

If you order through a third-party delivery partner (such as DoorDash, Uber Eats, Grubhub, or Caviar), that order is fulfilled and delivered under that company's terms, and its pricing, fees, and delivery policies apply.

cancellations and refunds

Because much of what we make is prepared to order, cancellations and refunds are governed by our Refund & Cancellation Policy, available at batterandcrumbs.com/refunds, which is incorporated into these Terms.

allergens and food safety

All of our food is 100% vegan (made without animal products). Our baked goods are made without nuts, but we use almond milk and, on occasion, nut-containing syrups at the coffee bar, and because equipment is shared (including the dishwasher), cross-contact with nuts is possible. Many of our items contain soy and wheat, and sesame cross-contact is also possible. Because we use shared equipment, we can't guarantee that any item is free from these allergens. If you have a food allergy, please tell us when you order so we can take extra care, and understand that you order at your own discretion.

gift cards and the crumb club

Gift cards and our Crumb Club loyalty program are provided through Square and are also subject to Square's applicable terms. Gift cards are not redeemable for cash except where required by law, and loyalty points or rewards have no cash value and may change or end over time.

intellectual property

The Batter & Crumbs name and logo, and the text, photographs, graphics, and design of this website, are owned by or licensed to us and are protected by intellectual-property laws. You may not copy, reproduce, or use them without our written permission, except for personal, non-commercial viewing of the site.

acceptable use

You agree not to use the site unlawfully, to submit false information, to interfere with or disrupt the site or its security features (including our spam protection), or to attempt to access areas or data you are not authorized to access.

third-party links and services

Our site links to and relies on services we don't control, including Square, our delivery partners, and our social media profiles. We are not responsible for the content, products, or practices of those third parties, and your use of them is governed by their terms.

disclaimers

The website and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or secure.

limitation of liability

To the fullest extent permitted by law, Batter & Crumbs and its owners and staff will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the site or your orders. Where liability cannot be excluded, it is limited to the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

indemnification

You agree to indemnify and hold Batter & Crumbs harmless from claims, losses, and expenses arising out of your misuse of the site or your violation of these Terms.

governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules, and any dispute will be handled in the state or federal courts located in Philadelphia, Pennsylvania.

changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and your continued use of the site means you accept the updated Terms.
